1. Overview

These Terms of Use govern your access to and use of Flare, our Shopify app and related services ("the Service"), operated by Flare Pay Ltd.

By installing or using Flare, you agree to be bound by these terms. If you do not agree, you must not use the Service.

2. Eligibility and access

To use Flare, you must have an active Shopify store and a valid Shopify account. You are responsible for maintaining the security of your store credentials and API access tokens.

• You must be authorised to accept these terms on behalf of your business
• You are responsible for all activity that occurs under your store's Flare installation

3. Your responsibilities

When using Flare, you agree to:

• Keep your login credentials and API access secure
• Take responsibility for your store data and how you configure Flare's features
• Not misuse, attempt to circumvent, or interfere with Flare's systems or infrastructure
• Not use Flare in any way that violates applicable laws or Shopify's Partner Programme policies

4. Billing & plan terms

Pricing is as listed on the Flare pricing page. All billing is processed through Shopify's billing system — Flare does not handle payment details directly.

• Subscriptions are billed monthly in advance through your Shopify account
• Plan downgrades and cancellations can be managed self-service via your Shopify admin
• Uninstalling the app constitutes cancellation of your subscription

We do not offer refunds for partial billing periods except where required by applicable consumer protection law.

5. Data use

Flare does not collect personal data directly from your customers unless it is strictly required for delivery date functionality — for example, storing a selected delivery date against an order.

All data handling is governed by our Privacy Policy, which forms part of these terms by reference.

6. Termination

You may stop using Flare and uninstall it at any time via your Shopify admin. Uninstallation cancels your subscription.

We reserve the right to suspend or terminate access to the Service without notice in cases of:

• Misuse or abuse of Flare's systems or infrastructure
• Violation of these terms or Shopify's policies
• Non-payment of outstanding charges

7. Disclaimer & liability

Flare is provided "as-is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or suitable for any particular purpose.

Nothing in these terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded by law.

8. Changes to terms

We may update these Terms of Use from time to time. Updated terms will be posted on this page with a revised "Last updated" date. For material changes, we will notify you by email or in-app notice.

Continued use of Flare after updated terms are posted constitutes your acceptance of the changes.

9. Professional services & custom development

When Flare provides custom development, configuration, or professional services engagements:

• All custom code and intellectual property developed by Flare remains the property of Flare Pay Ltd
• Clients receive a non-exclusive, non-transferable licence to use that code for their store only
• Reverse engineering, decompiling, or extracting Flare's proprietary logic is strictly prohibited
• Trial periods and proof-of-concept engagements do not grant rights to extract, copy, or replicate any processes, code, or configurations
